MEDFORD, Ore. (Jan. 2, 2026) — The Jackson County District Attorney’s Office has declined to file criminal charges in the fatal shooting of a 32-year-old man during a violent home invasion in central Medford last November, concluding the killing was legally justified self-defense under Oregon law.
District Attorney Patrick Green announced that his office will not pursue charges against David Rogers, 36, in the death of Martin Uriel Jimenez Jr., who was shot in the early morning hours of Nov. 2, 2025, at an apartment complex on Hawthorne Street.
After a comprehensive review of evidence collected by the Medford Police Department, prosecutors determined the only reasonable conclusion supported by the facts is that Rogers’ use of deadly force was justified.
Under Oregon law, a person may use deadly physical force if they reasonably believe another individual is using or is about to use unlawful deadly physical force. Prosecutors also found no evidence that Rogers was the initial aggressor, a condition that would prohibit a self-defense claim.
Police were dispatched to the apartment complex at about 3:30 a.m. after reports of gunshots. While officers were en route, a resident, later identified as Thomas Owens, 72, called 911 and reported that a man had broken into his apartment and was attempting to kill him.
Officers arrived to find Jimenez lying dead in the doorway of Owens’ apartment. Investigators noted the apartment door had been forcibly breached, with the door frame splintered inward. Owens was found with visible injuries, including active bleeding from his nose, and was treated at the scene by Mercy Flights personnel.
Rogers, a neighbor in the same complex, identified himself as the shooter and told officers his unloaded firearm was inside his apartment. Police said Rogers was cooperative and was briefly detained while the investigation continued.
Detectives determined that neither Owens nor Rogers knew Jimenez prior to the incident.
According to investigators, Rogers told detectives he was awakened by loud noises outside and heard what sounded like someone trying to break down a nearby apartment door. Looking out his window, Rogers said he saw Jimenez force entry into Owens’ apartment.
Rogers said he then heard Owens yelling for help and retrieved his handgun, a Glock 19, before leaving his apartment to intervene. When he entered Owens’ apartment, Rogers reported seeing Jimenez on top of Owens, repeatedly punching him.
Rogers shouted for Jimenez to stop, which briefly halted the attack. However, Jimenez then turned his attention toward Rogers and began advancing toward him, making growling noises, according to investigators. Rogers said he attempted to give Jimenez space to leave, but Jimenez continued approaching and reached for his firearm.
Believing Jimenez was about to use deadly force and possibly take his gun, Rogers fired three shots. All struck Jimenez, including one that hit his right hand before entering his torso, which investigators said corroborated Rogers’ account that Jimenez was reaching for the weapon.
Owens told detectives that Rogers’ account was accurate and said he believed Rogers had saved his life.
Investigators documented significant injuries to Owens, including facial bruising, a swollen lip, loosened teeth and pain that prevented him from lifting his upper lip.
Authorities determined Jimenez was intoxicated at the time of the incident and had been drinking heavily at a party at a nearby residence earlier that night. Friends told investigators Jimenez left the gathering on foot, declined offers for a ride or a place to sleep, and was not aggressive before leaving. Investigators said it remains unclear why Jimenez went to Owens’ apartment and attacked him without provocation, though his intoxication was believed to be a significant factor.
In a statement, the District Attorney’s Office thanked the Medford Police Department for its investigation and acknowledged the loss of life.
“While the evidence clearly supports a finding of justified self-defense, we recognize this was a tragic incident,” the statement said. “We extend our condolences to Mr. Jimenez’s family and friends as they cope with their loss.”
