Judge Deems Oregon Gun Measure 114 Unconstitutional

Harney County, Oregon – In a significant ruling today, Judge Robert S. Raschio declared Oregon’s voter-approved gun safety law, Measure 114, as unconstitutional. This decision comes after a lengthy trial and places the implementation of M114 on hold indefinitely.

The measure, which had been entangled in legal battles for nearly a year, faced its latest setback as Judge Raschio issued a permanent injunction. Initially, in December, the judge temporarily blocked the law from taking effect following a lawsuit filed by gun owners who argued that it violated Oregon’s Constitution. The legal saga also extended to federal court.

A July ruling in federal court concluded that Measure 114 did not infringe upon the U.S. Constitution.

The law, passed by narrow voter approval in November 2022, mandates individuals to undergo a criminal background check and complete a gun safety training course to obtain a permit for purchasing a firearm. Additionally, it imposes a ban on high-capacity magazines holding more than 10 rounds.

Critics of Measure 114, including the attorneys who challenged its constitutionality, denounce it as the “most extreme antigun law in the country.”

Oregon officials, including Governor Tina Kotek and Attorney General Ellen Rosenblum, are anticipated to file an appeal as defendants in the case.
