Jackson County Representative Helps House Pass Bill Targeting Deceptive Ticket Sales

Salem, Oregon- The Oregon House of Representatives has approved legislation aimed at curbing deceptive practices in the online ticket resale market. House Bill 3167, known as the Fan Fairness & Transparency Act, passed with a 40 to 16 vote and now moves to the state Senate for consideration.

The bill targets several longstanding issues in the entertainment ticketing industry, including hidden fees, speculative ticket listings, and unclear disclosures by secondary sellers. It introduces new requirements for ticket sellers to display full pricing upfront and bans the sale of tickets that the seller does not yet own.

“This bill is about restoring transparency in the entertainment industry,” said Rep. Pam Marsh (D–Southern Jackson County). “It’s about standing up for Oregonians who are tired of being deceived when they try to buy a ticket to see a favorite artist, support a local venue, or attend an event with their families.”

HB 3167 also mandates clearer labeling to distinguish between primary and secondary sellers, a measure intended to prevent consumer confusion and reduce the risk of purchasing invalid or overpriced tickets.

“Oregonians across the state have been scammed by the deceptive practices and hidden fees that have disrupted the arts industry – especially music and the performing arts – for far too long,” said Rep. Rob Nosse (D–Inner SE & Inner NE Portland). “This bill benefits everyone who buys tickets, along with the small, independent venues who legitimately sell them.”

The legislation creates a new enforcement mechanism by allowing a private right of action under Oregon’s existing Unfair Trade Practices Act. This provision gives consumers additional legal recourse in the event of fraudulent ticket sales.

With growing dependence on digital ticket platforms, lawmakers say the measure places Oregon among the leading states in consumer protection in the entertainment sector. The bill now awaits a vote in the Senate.
