Portland, Oregon- A 26-year-old murder suspect who was mistakenly released from the Multnomah County Detention Center earlier this week was arrested Thursday on the Oregon Coast, authorities said.
The Multnomah County Sheriff’s Office said deputies, with help from the U.S. Marshals Fugitive Task Force, arrested Ty Sage around 1 p.m. at a gas station off Highway 101 in Florence. No use of force was reported.
“Ty Sage should never have been able to post bail,” said Sheriff Nicole Morrisey O’Donnell. “To the family of Lowgunn Ivey, the young man killed, I want to acknowledge the fear and trauma that this mistaken release has caused.”
“Lowgunn’s family deserved better. As Multnomah County’s sheriff, I am committed to making sure this does not happen again, that we learn from our mistakes, and that Lowgunn’s family can have justice,” Morrisey O’Donnell added.
According to court documents, a Multnomah County grand jury indicted Sage on May 13 on charges of second-degree murder and first-degree robbery. He appeared before a Multnomah County Circuit Court judge Sept. 17 for a murder bail hearing, records show.
Sage was mistakenly allowed to post bail and was released from the Multnomah County Detention Center on Monday, Sept. 22. The sheriff’s office discovered his release the next day.
A preliminary review indicates a misinterpretation of a court order filed Sept. 18 led to the release, the sheriff’s office said. Morrisey O’Donnell immediately launched an internal inquiry that remains ongoing.
Although sheriff’s employees acted in good faith and sought clarification with the court, “Sage was still allowed to post bail – that should not have happened,” the sheriff’s office said in a statement.
Morrisey O’Donnell said the department will strengthen its procedures to prevent similar mistakes. She praised deputies and investigators who “have been working non-stop from the beginning of this incident and who dedicated themselves to bringing Sage into custody.”
Sage will be booked back into the detention center on a no-bail hold.
Morrisey O’Donnell said she has spoken with Ivey’s family to inform them of the arrest and thanked the U.S. Marshals Service, the Multnomah County Circuit Court, the Multnomah County District Attorney’s Office, and the Gresham Police Department for assisting with the case.
