A Jackson County grand jury found the actions of the Medford Police Department (MPD) officer-involved shooting earlier this month was a justified use of force under Oregon law. Jackson County District Attorney Beth Heckert presented the case to the grand jury earlier this week. The shooting occurred in the early morning hours of April 2nd when MPD officers dispatched to a call for an armed, suicidal subject.
On April 2nd around 4:55 a.m. the suspect exited his vehicle and held a handgun to his head. MPD officers attempted to diffuse the situation. The suspect then lowered the handgun from his head to his chest and fired one shot. The bullet passed through his upper left chest and exited out the back of his left arm. The MPD officer saw the muzzle flash and believed the suspect had fired at him. The officer returned fire, firing three times. The investigation revealed those shots struck the driver’s side door window and the driver’s door. The officer did not strike the suspect with a bullet from his gun. MPD officers then began rendering life-saving aid until the suspect was transported to a local hospital. The suspect has since been released from the hospital, but was admitted to the Behavioral Health Unit on a medical hold. The investigation revealed he was under the influence of alcohol and cocaine during the incident.
The hearing included testimony from several witnesses to include the officers who were present at the time of the shooting. The grand jury found the actions of MPD Officer Joshua Marshall was justified and in compliance with Oregon law. The grand jury also returned an indictment against the suspect for driving under the influence, recklessly endangering, and second-degree disorderly conduct. The suspect, Tyler Timothy Delugach, 24, of Central Point was lodged in the Jackson County Jail.
Jackson County Sheriff’s Office (JCSO) was the lead agency on the investigation assisted by Oregon State Police (OSP) and members of the Major Assault and Death Investigative Unit (MADIU). The MADIU team is comprised of detectives from OSP, JCSO, MPD, Central Point Police Department and the Jackson County District Attorney’s Office.
