Medford Law Firm Preparing to Take Asante to Court

Medford, Oregon- In a recent interview with Medford Alert, David deVilleneuve, president and senior attorney of Shlesinger & deVilleneuve Attorneys, shed light on the firm’s work in representing victims and their families in the wake of alarming claims of “drug diversion” at Asante, potentially resulting in the deaths of several patients.

When asked about the resources dedicated to the Asante litigation, deVilleneuve highlighted the formation of a specialized team, comprising experienced attorneys and legal assistants. With over 29 years of legal expertise, deVilleneuve emphasized their firm’s substantial financial capacity to pursue claims against Asante to the fullest extent allowed by law. “Our firm has millions of dollars at our disposal to pursue these claims to the fullest the law allows” deVilleneuve remarked.

The goals outlined by the deVilleneuve legal team for victims and their families are threefold: securing legal compensation, preventing future incidents at Asante, and raising public awareness about the truth behind the alleged negligence. DeVilleneuve emphasized the importance of holding Asante accountable and motivating medical providers to take necessary measures to prevent similar occurrences.

Addressing the question of a class-action route, deVilleneuve refrained from recommending it at this stage, urging individual independent court actions for victims. He stated that the potential shift to a class-action approach would be considered as the investigation unfolds.

On the possibility of settlement, deVilleneuve expressed skepticism, citing no visible efforts from Asante to settle: “I have seen no efforts by Asante to settle these cases. I will be filing court actions for all our clients. My prior experience dealing with Asante malpractice claims suggests they will resist settlement and we will be eager to go to court. Of course, if Asante wishes to make efforts to compensate these victims, I will present these offers to all my clients. Until then, we will be taking these matters to court.” He affirmed their readiness to file court actions for all clients and conveyed a willingness to present any compensation offers from Asante if they arise.

Regarding the number of clients represented, deVilleneuve disclosed ongoing communication with multiple clients and potential representation for others considering legal action. “We have multiple clients at this time, and we are in communication with other victims who are considering having us represent them.”

As other local law firms engage with Asante victims, deVilleneuve conveyed confidence in winning cases independently but encouraged collaboration for a more effective pursuit of justice. He underscored the collective responsibility of law firms to work together in the interest of the victims.

In a concluding statement, deVilleneuve condemned the shocking actions of the Asante employee, emphasizing the tragic consequences for patients. He stressed the firm’s commitment to ensuring that those responsible are held accountable, expressing an honor in representing the victims and their families in their quest for justice. “Due to the horrendous actions of an Asante employee, people have died and people have been severely injured while being patients at Asante. This is shocking. Justice demands that the victims and families of the victims have their voices heard. This should never have happened in a health care facility. The best way to make sure this never happens again is for the victims and their families to have those responsible pay for their negligence. We would be honored to represent these victims.”
